In the name of God Amen.
I Dollin Cain sick and weak in body but of good and perfect memory
praised be God. I make by last will and testament in form and manner
following.
First I commend my soul to Almighty God and my body to Christian burial and
dispose of my worldly goods as followeth:
I leave and bequeath to ye poor three firletts of meal to be distributed
among them.
I leave and bequeath to my daughter Catherine all my houses and lands crop
and team wholly to which the wife hath given her consent for her part, as
also to my said daughter the husbandry gears always provided that if my wife
be with child and the child on her bearing it to be a son
then the said child on her bearing is to have all the above particulars
left to my said daughter and in that case my daughter Catherine to be
joint executrix with my daughter Anne if my wife prove with child of a
daughter then my said daughter Anne and the presumed daughter to be joint
executrixes and if not with child at all that then my daughter Anne
is to be sole executrix of all my worldly goods of which nature so ever
except that before left and bequeathed to my daughter Catherine.
I leave and commit the tuition of my children and their goods and lands
to my loving wife until my heir whether son or daughter come to lawful years
and appoint my loving friends Parson John Christian and Thos Corlett, my
brother in law, supervisor of my said children and leave as legacy to the
said Thos Corlett and to Parson Christian forty shillings.
I leave to Philip Corlett my coat and to my brother Jon my large coat
and wearing coat.
It is my will that if my brother John live with my wife and assist her as
best he can that then my wife maintain him when he lives so with her. I____
and clothes and give him the keeping of two _____ winter and summer. And to
my sister Joney a heiffer.
To my sister Mary which is in her own hands.
It leave upon my wife that she make up the loss of it was and to have the
loose boards in or about the house towards it.
I leave to my wife a brown colt as legacy and will that if all my children
dye under age that my wife have three pounds of their goods. And to
witnesses to my last will and testament have published the same this 18th

Whereas there has been a controversy about Mr Thos Clerk of West
Nappin and the Rev'd Wm Christian Vicar of Jurby touching the last will
and testament of Dollin Cain bearing date 18th February 1694. As also
concerning other particulars annexed to the said will and the said
parties having obliged themselves by bond dated the 29th March 1728 to abide
by and rest satisfied with the judgment and arbitration of Capt
Wm Christian and Mr Thos Corlett and in case of their difference by the
marriage of the Revd Mr Edward Moore Curate of KK Andreas; tis this day
unanimously conscented accordingly and agreeable to, by and betwixt,
the said partys that for a full and final end of all strife debates and
controversy though any claims and demands to lands and houses goods or
chattels of what nature soever which either of the said parties have had or
may have one upon another by virtue of the last will of Dollin Cain aforesd
or by reason of any pretended defect in the same. That the following
decision is to stand and be final and conclusive vizt: That Mr
Clerk is to have the full benefit of the half crop of corn in East Nappin
namely of what was possessed by his mother in law at the time of her death
and that he shall have passable ways and libertys to carry the said half
crop to his own estates and not be obliged to take his beasts (unless it be
his own pleasure) out of the grass before all Hallow tide inst.
In consideration of which tis agreed that Mr Christian is to have all the
dung of the East Nappin belonging to the executrix of his mother in laws
together with lime stones lying on the side estate as also the grass of
the quarterland -----------------
by the said deceased mother in law at her death. Tis agreed that Mr
Christian is to have the grass, hay and ------- of the same excepting of
the south end of Close y Geyl, Drim ye Close, Gatl, and Croit Y Cain and
Lheance Moar which Mr Clerk is to hold and have the whole benefit of
until all Hallow tide next as afore mentioned. As to paying the Lords rent
belonging to he deceadents part of the Nappin and Curragh It is
consented to that Mr Christian is for the parcells to be enjoyed by him to
pay twelve shillings and Mr Clerk the other twenty four shillings and
that Mr Christian is to pay the ----- of the beasts provided by him or his
family belonging to Mr Clerk without any further allowance for the same.
In lieu of Mr Christian pretensions to any part of the crop or team which
may be yet unsatisfy'd he is to pay the ---- from the said Mr Clerk
besides the particular aforementioned the fourth choice bullock of the
deceadants team with an heifer for his son Thomas and also for what he may
want of the corbs a spit, Racken tree and tripods and likewise two
bed stead vizt those standing in the old dwelling house of the Nappin.
Lastly for the performance of all and singular the presents of both
party's have bound themselves, their heirs, executors and administrators and
assigns in the penalty of two hundred pounds in the nature of all
fines with this Isle as witness my subscription this 27th of June 1728. Thos
