Lonan 1719 Daniel Looney of Ballamoar, the famous mason, departed this life abt the 29th of Feb intestate, whereupon the Court has decreed his 2 children vizt Ellinr by his first wife & Wm Looney by the second joint Admrs of all his goods & chattles moveable & immoveable; who being both at age but Wm at present out of the Island; & Wm incapable to take the charge of the Administration the same is committed in trust unto Daniel Looney the Heir; who is sworn to bring in a perfect Inventory & to render a faithful acct to the Adms and he is also order'd not to make sale in his sisters absence of more of the effects than will be found necessary to discharge such debts as the Court shall adjudge to be pd. Suo tamen unicuique mem: If it shall appear hereafter that pro jure Ellin rec'd any goods from her fa= ther since her marriage she is to have no .... ..... Adminstration The wife is also sworn to be true to the Admrs not to consume any of the effects etc. Decretum est & solvit 2s 8d May 10th 1720 Philip Curlet of Balnemoney has this day in presence of the widow & Dan. Looney ye Heir, & also in presence of Elinr Looney, deposed that Dan. Looney decd ow'd him ye sum of four pounds at the time of his death wch sd £4 the sd Philip lent him abt the 10th or 11th of Novr last. This before us Wm Walker Cha: Watleworth Whereas Daniel Looney senr of KK Lonnon departed this life lately intestate; And that his Goods & Effects do fall far short to pay & discharge his debts, which amount to about thirty five pounds, his Inventory by the near= est computation not exceeding twenty two pounds: And forasmuch as his Admr vizt William Looney is young & not fit to tak the Adminstration upon himself, and Nelly Looney is absent in Ireland; their eldest brotherHenryLouis therefore sworn Admr in their behalf according to Law. Now in regard the relict of the sd Daniel Looneyals Casementviz Grace Looney als Casement has right & title to some interests in KK Christ Lezayre to which the sd Admr claims part vizt the crops thereof; And to ........ all Differences about the Sd Dan Looney senr's Goods & Debts etc. It is there= fore by the sd Dan Looney junr, William Looney with the full consent of his uncle Edward ...... KK Andreas & the sd Grace Looney als Casement agreed .... as follows 1st The sd Dan Looney junr and the sd Will Looney do hereby resign acquit & ..over all the right title & interest that they, or the sd Nelly Looney, have or hereater may have to the sd Intacks .... & apur= tenances belonging to the Heir of he sd Grace Looney als Casement in the parish of KK Christ Lezayre and and the profits thereof: as well as all the Goods moveable & immoveable of the sd Dan Looney senr unto the sd Grace Loooney als Casement & to her Execrs Admons & assigns forever. 2 In consideration the sd resignation sd Grace Looney als Casement doth herbey bind & oblige herself to pay & discharge all debts whatever that are & will fall due on the sd Dan: Looney senr's Admrs according to Law. As also to resign her right & title to ye widow right that is due unto her in the [Farm] .... Ballamoe in KK Lonnon (excepting ye morgaged's Land) unto the sd Dan: Looney junr for ever. More =over acquitting & resigning the crop of corn now remaining unthraghd in the haggard & bar... unto ye sd Daniel Looney junr; who obliges himself to warrant & defend the sd Grace Looney als Casement from whatever right & title the sd Nelly Looney may or shall claim to any part of Dan Looney senr Goods & Effect or profits due unto his Admrs. upon any manner of account or means whatsoever, for the future. For performance of all & singular the premises the aforesd partys do hereby bind & oblige themselves their Execrs Admrs & Assigns in the penalty of sixty pounds Fine, accordig to the Law & Practice of this Island. As witness their marks to their names this 10 March 1719/20 Witnesses Daniel Loone jur his mark D Charles Watleworth Willm Looney his mark W Jon Wattleworth Grace Looney her mark G Ewan Lawson Mary Looney als Clark her mark May 5 1720 Nelly Looney daugtr to Dan: Looney decd having come lately out of Ireland & fully understanding her Father's cirucm= stances at his death, is very well satisfy'd with the Covenant & Conditions of the within agreement made by her brothers Dan: Looney & Wm Looney & her step mother Grace Looney als Casement. And she doth hereby resign & surrender all her right and title the Intaks house & appurtences belonging to ye heir of the sd Grace ....... in KK Xt Lezayre, as well as to ye profits thereof, unto her sd step mother for ever; together with all her part or half of the Executership due unto her by the death of her Father Dan: Looney aforesd: .... ys covenant & conditions mentioned in the above Agreement ex...ing half or her part of whatever her brothers Dan: & Will Looney got & procur'd from her step mother for the same vizt; the profits of the widowright, & the crop & corn remaing in ye haggard & barn. As witness her mark to her name Nelly Kelly als Looney N Acknowledged before me Chas: Watleworth Official At Lezaire, May 20 1720 It being controverted this day betwixt Daniel Looney & his sister Ellinr whether she the sd Ellinr recd any part of her Father's goods wch might exclude her from a proportion of the Admcon. It is agreed & concluded on, rather than any oaths shou'd be taken, or any other process be in yt matter, the he the sd Daiel shou'd pay his said sister thirty shills next Monday, in full of all yt was resign'd to him by their step mother Grace Looney als casement, in consideration of surrendering the Admcon into her the sd Grace's hand: with wch Ellinr is intirely satisfied, & does again ratify her Articles hereunto annexed. Die suynad. All the goods of the decedt are comitted to the widow, as before specified, who has given pledges to pay all debts, & secure the office, Mr Jo: Garret, & Mr Wm. Casement. To ye Rt Reverend ye Lord Bishop of this Isle, together wth ye rest of ye Reverend Courts The most humble peticon of Elnr Loonney Meekly showing How your peticonr being settled in Ireland & having some small effects due to her by ye decease of her mother as also hearing of her dear Father Dan: Looney decease intestate did move her coming to ye Island where she aprhends yt ye Court hath decreed ye younger brother Wm Loonney & your peticoner Admnns but ye sd Wm being young & nott fitt for such a undertaking, & your pticoner nott then in ye cuntrey, ye eldest brother Dan: Loonney was sworn Admir, who finding yt his father ye sd Dan: Loonney debts did considerably exceed ye effects, maide an agreemt wth his stepmother Grace Loonney als Casemt as folowes, First ye sd Dan: Loonney junior did deliver upp all ye sd effects unto ye hadnd of ye sd Grace hiss stepmother ass allsoe ye future profits of ye Intack situaste in KK Christ Lizayre & in considracon thereof ye sd Grace wass obliged to pay ye whole of all ye debts wtsovever ass allsoe to resigne all her right to her wiows right to Ballaamond in KK Lonnon wth a cropp of corne sowen in ye ground & likewise with y corne haggared & barne; And now your peticonr being being assured & maide ...... yt ye sd debts did exceed ye effects as aforsd she did not only approve of ye Agreement butt also signed ye same, .... yt sd Grace her stepmoter shud have all ye profit of ye Intacks in Lezayre wth allye effects ye sd Grace paying al ye debts soever our peticonr resrving ye proportion due to her for ye resignation of ye sd widdow= =right corpp of corn sown, wth ye corn in y haggard & brnd Soe your poor peticonr (who longs to be with her familia) most humbly implores your Wship (with ye rest of ye Reverend Court) may be graciously pleased to take ye ...... unto your judicious consideracon, & ...... her suh considacon for ye resignation of ye sd widowright, ye cropp of corn; wth ye corn in ye haggard & barn ....... ...... with ye rest of ye ...... counsel shall in your [grave] judgmnt in equity & justice ... ..... ... shall all in juty bound ........
