KELLY, Philip 1762-3 Mar BALLGRAUE E w This is affirmed to be the last Will and Testament of Philp Kelly of Balnegrave in the parish of Marown who departed this life at or about the 1st day of November 1762 being in sound mind and memory at the making hereof. First, he committed his soul to god, and his body to a Christian burial He left to his daughter Anne ten shills legacy as also a sheep He left to his daughter Margt a sheep He left to his son Robt a sheep He left to his son Phillip all his lands, as well, Quarter land, as intacks and left the said lands to his wife during her natural life, and after her decease to be at the whole disposal of the said Philip his son to which his wife gave her consent on and at the time that his said son was to possess the lands he required that he was to pay or cause to be paid unto his son Robert, four pounds and also to his sister Marg’t the like sum but provided that the above named Philip, Robt, and Marg’t should dye before their mother then and in that case, her own part of the said lands was to be at his own disposal. Lastly he nominated constituted and appointed his loving wife Catherine Kelly whole and sole executrix of all the rest of his goods moveable and immoveable of whatever kind or nature soever, and that upon condition that she his said wife was to put his son Robert to a trade. Witness John Kelly Wm Cain } Jurati At a chapter court holden at Kk Braddan 9th November 1762 The executrix is sworn in court in form of law and hath given her consent in Court that her part of all the Lands as well quarterlands as intack shall also fall and become due to her son Philip upon the seventh covenants conditions & provisions as now fully specified in this said will after her decease. She hath for these ends as also for payment of debts and legacies given pledges, namely John Kelly and Wm Cain both of Marown the witnesses of the will. To wit 18d Probatum est Ro Radcliffe Matth Curghey At Kk Patrick 5th Nov 1779 John Fayle Husbd of Marg’t Kelly daugh[ter] of the testator Philip Kelly has this day acknowledged to have recd from his brother-in-law Philip Kelly the s[aid] legacy of four pounds and every other legacy bequeathed to her by her s[aid] father and hereby acquits exonerates and discharges the said Philip Kelly and every other person of the same and every part thereof as witness his name and mark the day above written John Fayle my x mark This before me Ed Christian
