8     Lonan
In the name of God, amen. I, Thomas Quayle 
of Ballagare, being of sound mind and memory 
and considering the uncertainty of life and 
being desirous that my worldly affects be 
disposed of in manner following do therefore 
make this my last will and testament as 
hereafter set forth: 
I recommend my soul to God and my body 
to Christian burial at the discretion 
of my executor hereafter named. And whereas 
my late deceased brother Philip Quayle 
oftentimes in his life mentioned that he 
meant to give to the poor of the parish 
of Lonan aforesaid the sum of twenty pounds, 
but having died intestate, the said 
intentioned bequest was never made. And 
I the said Thomas Quayle being desirous 
that my said deceased brother’s intention 
should be.. into execution, and being also 
willing to leave the further sum of twenty 
pounds unto them myself, I do therefore 
give and bequeath unto the poor of the 
said Parish of Lonan the sum of forty pounds 
aforesaid to be laid out at interest for 
their use by the Vicar and Wardens of the 
said Parish for the time being forever and 
that at the distribution of such interest 
the propr.. of the estate of Ballagare 
aforesaid for the time being is to have 
and or need[?]. I leave and bequeath unto 
my servant Charles Cannon the sum of fifty 
pounds together with all and singular the 
half of my sheep ewes and lambs of what 
kind or nature soever (save and except 
so much or so many as shall be made use 
of by my funeral), which is in full of 
all wages or other demand that he may 
have upon my Estates, provided and nevertheless 
that the said Charles Cannon shall misbehave 
himself so that I shall be obliged or thing 
proper to discharge him before my decease, 
or that I shall sell off the Estate of Ballagare 
so that I shall have no occasion for him or 
that he shall make any claim upon my estate 
or effects that then in all or any of the 
said cases, the said bequest shall be null 
and void and the same be the sole property 
of my executor. I leave and bequeath unto 
my maidservant Ann Kerruish the sum of 
thirty five pounds besides five pounds per 
annum during her life to be paid by my 
executor or his executors administrators 
or assigns which is meant to be in full 
of all wages or other demands she may have 
upon my Estate or effects . . . 
I leave and bequeath to my maidservant 
Alice Croaghan the sum of twenty four pounds 
ten shillings, which is hereby meant to be 
in full of all wages and demands she may have . . . 
I leave and bequeath to my servant David 
Croaghan the sum of five pounds . . . 
And whereas I did make a will dated 28th 
day of xxx 1782 leaving and bequeathing 
to Philip Skillicorn of Lxxx, weaver, a 
parcel of land purchased by myself and 
two brothers from Philip and William 
Corrin as his deeds dated respectively 
2nd July 1781 and 29th July 1785, may 
appear, but some time after the execution 
of the said Will the said Philip Skillicorn 
prevailed upon me (in order the better 
to secure to himself the foresaid parcel 
of lands) to execute a bill of sale of 
the same in his favor for the consideration 
money of one hundred fifty pounds or 
thereabouts, which consideration money 
or other kind of value I now declare I 
never received, and the bill of sale was 
to remain in my own keping and custody 
till after my decease, but sometime 
afterwards the said Philip Skillicorn 
by flattery and pretended friendship 
got and obtained the said bill of sale 
into his own possession with a promist 
of restoring the same whenever I might 
think proper to demand the Bill, is, 
after having frequently and respectfully 
applied to him for the same, that he hath 
utterly refused to return it to me. For 
this and other reasons of his misconduct 
and bad behavior to me I do hereby withdraw 
and declare every kind of right or title 
he might derive from the said Bill of 
Sale fraudulently and unjustly detained 
from me to be null and void. . . 
I do give devise and bequeath unto my 
loving kinsman Mr. William Crebbin of 
Douglas, merchant, all and singular my 
Estates of Ballagare and Ballamilgin 
with the houses thereon erected together 
with the intacks thereunto belonging, 
as also the two parcels of land purchased 
by myself and two brothers from Philip 
and William Corrin before recited in 
as full and ample a manner as I purchased 
from my deceased brother Philip Quayle 
before named by deed dated 26th February 1780. 
And I do hereby nominate constitute and 
appoint him the said William Crebbin whole 
and sole executor of this my last 
unalterable and irrevocable will and 
testament as also residuary legatee of 
all and singular my goods chattels mortgages 
bills bonds cash credits and effects moveable 
and immovable of what kind or nature soever 
hereby revoking and nullifying every former 
will an debarring all and every person or 
persons who may make claim upon my estate 
(other than as herein before mentioned and 
just debts) with two shillings and eleven 
pence legacy. As witness my mark to my name 
this 21st day of August 1786.

Be it known to all men by these present 
that I Thomas Quayle of Ballagare in the 
Parish of Lonan have made and declared 
my last will and testament in writing 
bearing date the first day of August one 
thousand seven hundred and eighty six, 
and I the said Thomas Quayle by this 
present Codicil ratify and confirm my 
said last will and testament in every 
respect and I do hereby solemnly declare 
that I never gave consent to the attestation 
of the Bill of Sale which I gave to 
Philip Skillicorn nor ever received the 
consideration money therein mentioned 
all which I am ready to make oath thereto 
upon knees and that if such attestation 
may appear to said deed that it was an 
imposition on me. And I do thereby revoke 
and nullify any former will or wills that 
I have made hereby ratifying and confirming 
this my Codicil to the said last irrevocable 
and unalterable will and testament. 
In witness whereof I have put my mark to 
my name this second of June one thousand 
seven hundred and eighty nine.

Whereas I have made my last will and 
testament bearing date 21st August one 
thousand seven hundred and eighty six 
and the Codicil thereto bearing date 
the second June one thousand seven 
hundred and eight nine; now I do by 
this second Codicil to my said will 
wholly revoke and make void the legacy 
of one hundred and fifty pounds 
bequeathed to Philip Skillicorn in and 
by the foresaid will on account of his 
conduct respecting the Bill of Sale 
mentioned in the first Will, and I 
hereby devise the premises mentioned 
in the said Bill of Sale and claimed 
by the said Phil Skillicorn, unto my 
kinsman William Crebbin his heirs and 
assigns and I do hereby further ratify 
and confirm my before mentioned will 
and testament and the Codicil thereunto 
belonging to my last and unalterable 
and irrevocable will and Codicil. 
In witness whereof I have put my mark 
to my name this 13 day of March 1797.

At an Eccliastical Court holden 
in the house of the Reverend Thomas Quayle 
Vicar of Onchan in the Parish of Kirk Onchan 
on the xxx day of January on thousand 
seven hundred and ninety eight, 
the said Thomas Quayle and Richard Symons 
two of the subscribing witnesses of the 
annexed last will and testament of Thomas 
Quayle of Ballagare in the parish of Lonan 
dated the 21st day of August 1786, being 
sworn upon the Holy Evangelist, deposed 
and made oath that the said testator when 
of sound and disposing mind memory and 
understanding duly signed published and 
declared the said Will and testament 
that they at his request and in his 
presence and also in the presence of 
each other subscribed their names to 
the said will as witnesses thereto and the 
said Thomas Quayle and Richard Symons and 
also Thomas Croaghan the subscribing 
witnesses to a paper writing annexed 
to the said will and purporting to be 
a Codicil to the said will and dated 
the 2nd day of June 1789 . . . 
and John Quine and Thomas Croaghan the 
subscribing witnesses of the paper 
writing dated the 13th day of March 1797 
and purporting to be another Codicil 
to the said will having been sworn on 
the Holy Evangelist . . .

The humble petition of Philip Skillicorn 
of the parish of Lonan Sheweth that 
Thomas Quayle late of Ballagare in 
the said parish departed this life 
on or about the 23rd day of December 
last, that previous to his decease 
to wit on or about the 2nd day of 
August 1788, the said Thomas Quayle 
did by deed by him dule executed for 
certain good causes and considerations 
him xxx gift and grant unto and upon 
your petitioner certain lands and 
premises thereon mentioned and 
also all his the said Thomas Quayle’s 
goods and chattels of what kind or 
nature soever to be possessed by 
your petitioner upon the decease 
of him the said Thomas Quayle as 
by the said deed dated the 2nd of 
August 1788 and duly attested by 
and before the Deemster upon the 
26th day of May 1793, may more 
fully appear xxx to which your 
petitioner craves leave to refer; 
that shortly before the death of 
the said Thomas Quayle and at a 
time when the said Thomas Quayle 
was extremely weak both in body 
and mind, he the said Thomas Quayle 
was removed from his own habitation 
in the parish of KK Lonan to the 
house of William Crebbin of the 
town of Douglas, merchant, where 
he the said Thomas Quayle departed 
this life; that the said Thomas 
Quayle’s xxable papers and cash 
to a considerable amount were 
removed to the house of the 
said William Crebbin along with 
the said Thomas Quayle and the 
said papers and cash now remain 
in the said William Crebbin’s 
possession; that you petitioner 
is become entitled to the said 
papers cash and other goods and 
effects of the said Thomas Quayle 
under and by virtue of the deed 
of gift aforesaid . . . 

Ordered that the before going petition 
do come on to be heard before me in an 
Ecclesiastical Court to be holden in 
the house of the Revd. Thomas Quayle 
Vicar of KK Onchan on Saturday next 
whereof all proper parties and persons 
to have due notice. 
Given at KK Patrick 3rd January 1798.

The humble petition of William Crebbin 
of the town of Douglas, merchant, 
Sheweth 
that Thomas Quayle of Ballagare in 
the parish of Lonan did sometime 
ago depart this life possessed of 
certain goods, chattels, and effects 
to a considerable amount, that said 
Thomas Quayle did on or about the 
21st day of August 1786 duly publish, 
declare, and execute his last will 
and testament . . . 
that the Revd. Thomas Quayle Vicar 
of KK Conchan, one of the subscribing 
witnesses to the execution of the said 
testator is at present much indisposed 
and xxx very fast declining, wherefore 
it becomes absolutely necessary to 
have the testimony of the said Thomas 
Quayle for xx taken, in under consideration 
whereof your petitioner most humbly 
prays that your Reverence will be 
pleased to appoint some near day 
for the xxx of this petition and that 
witnesses to the xxx of the said will 
may be examined and the execution 
thereof committed to your petitioner . . . 

Ordered that the before going petition 
be heard before me at Eccesiastical Court 
to be holden in the house of the Revd. 
Thomas Quayle Vicar of KK Onchan on 
Saturday next at twelve o’clock at noon . . 
given at KK Patrick 3rd January 1798.

The humble petition of Hester Crebbin 
of the town of Douglas, widow, 
sheweth 
that Thomas Quayle of Ballagare in 
KK Lonan did some time ago depart 
this life but previous to such his 
decease did duly make, publish and 
declare his last will and testament 
and did thereof appoint William Crebbin 
late of the town of Douglas deceased 
sole executor and residuary legatee; 
that the said Will was proved before 
your Reverence by the witnesses to 
have been duly executed but the said 
William Crebbin departed this life 
before he was sworn executor of the 
said will; that the said William 
Crebbin did duly make, publish, 
and declare his last will and testament 
and did thereof appoint the said 
petitioner sold executor and residuary 
legatee and also the petitioner hath 
been sworn duly to execute and fulfill 
the said accordingly; that Philip 
Skillicorn of KK Lonan aforesaid has 
of late thought proper to set up a 
deed pretended to have been executed 
by the said Thomas Quayle deceased 
and the said Philip Skillicorn pretends 
and xxx that the whole of the Estate 
and effects which was of the said 
Thomas Quayle . . .; 
that your petitioner charges that 
the said deed was not duly executed 
by the said Thomas Quayle and that 
therefor the said deed is not sufficient 
to grant or convey the property of 
the said Thomas Quayle . . .; 
in under consideration whereof your 
petitioner most humly prays a hearing 
of this petitioner and that the said 
will of the said Thomas Quayle deceased 
may be accepted and taken as and for 
the last will and testament of Thomas Quayle . . . 

Ordered that this petition do come on 
to be heard at a Consistory Court to 
be holden at KK Michael on Wednesday 
next whereof all proper parties and persons 
to have due notice. Given this 19th day of May 1798.

The petition of Philip Skillicorn of KK Lonan, 
Sheweth 
that Thomas Quayle late of Ballagare in the 
parish but now deceased did by deed xxx 
duly executed and bearing date the 2nd 
day of August 1788, gift and grant unto 
and upon your petitioner his goods and 
chattels of what kind or nature soever 
to be possessed by your petitioner at the 
death of the said Thomas Quayle as by said 
deed may more xxx appear and to which your 
petitioner craves leave to refer; that the 
said Thomas Quayle departed this life in 
or about the month of February last 
whereupon your petitioner preferred his 
petition to the Revd. Vicar General Christian 
praying the said deed might be accepted 
as the will of the said Thomas Quayle; 
that William Crebbin then of the town of 
Douglas, merchant, but since deceased did 
at or about the same time xxx a petition 
to His Reverence xxx that the said Thomas 
Quayle had xxx a will and had appointed 
him the said William Crebbin executor of 
the said will and might be proved and 
that the said William Crebbin should 
be sworn executor thereof; that the 
said petitioner came on to be heard 
before His Reverence the said Vicar 
General Christian at one and the same 
time together whereupon His Reverence 
was pleased to postpone any further 
proceeding therein until the same 
should be brought before a full Court; 
and before any other or further proceeding 
was xxx the said petitioner, the said 
William Crebbin departed this life having 
previous thereto made and published his 
last will and testament in writing and 
thereof appointed Hester Crebbin then 
his wife but now his widow sole executor 
who hath been duly sworn executrix of 
the said will . . .; 
wherefore your petitioner prays for 
a hearing of the petitioner and that 
the said deed may be accepted as the 
will and testament of Thomas Quayle . . . 

Ordered that this petition do come on 
to be heard at a Consistory Court to 
be held at KK Michael on Thursday the 
26th instant, whereof all proper parties 
and persons to have due notice; 
given at KK Patrick the 19th day of April 1798. 

At a Consistory Court holden at 
KK Michael, the 26th day of April 1798, 
upon motion of the xxx advocate, 
this petition is ordered to be recorded 
in the Episcopal Registry and the xxx 
are ordered to come to be heard at 
Consistory Court to be holden at the 
house of Thomas Cannell in KK Michael 
upon Wednesday the 23rd of May next 
by eleven o’clock in the prenoon 
whereof all proper parties and 
persons have due notice.

On the petition of Philip Skillicorn 
I have charged Robert Kneale and Catherine 
his wife, Henry Skillicorn senior, 
and Thomas Quayle the next of kin of 
Thomas Quayle late deceased xxx said 
petition to appear at a Consistory 
Court to be holden at the house of 
Thomas Cannell in KK Michael upon 
Wednesday the 23 of May instant [1798] 
by eleven of the clock . . .

Minutes of an agreement between 
Mrs. Hester Crebbin executrix of 
the late Mr. William Crebbin & 
Thomas Quayle and Philip Skillicorn, 
December 13th, 1798
That Skillicorn is to have all the lands 
mortgages and other matters specifically 
mentioned in the deed from Thomas Quayle 
and is to release all the rest to 
Mrs. Crebbin and to pay one half of each 
of the legacies bequeathed by the will of 
Quayle as are recoverable except any specific 
legacy which may be left to Mr. Crebbin 
or any of his family if any such there 
be, and the said Mrs. Crebbin is to give 
a general release to Skillicorn including 
the lands which were sold to Skillicorn 
by Quayle by deed dated the 19th July 1783. 
The said parties also agree to execute 
proper deeds to carry this agreement 
into effect.

At Consistory Court in the 
Parish of KK Patrick on the 
xxx day of December 1798
William Crebbin the executor named and 
appointed in the before going will of 
Thomas Quayle of Ballagare in the parish 
of Kirk Lonan having lately departed 
xxx Hester Crebbin the executrix of 
his the said William Crebbin’s last 
will and testament, is therefore and 
in virtue of an agreement between her 
and Philip Skillicorn hereunto annexed 
sworn executors of the xxx said will 
in form of law and hath given pledges 
for the payment of his just debts 
and legacies namely Harry Grice Esquire 
her son in law and Thomas Gawn of Lezayre Esquire.
