Know all men by these presents that I John Oates of Ballafurt in the
parish of Santan by and with the consent and approbation of Margaret Oates
otherwise Shimmin my wife divers good and valuable causes us hereunto moving
for and in consideration of the natural love and
affection which we have and do bear to and for our eldest son and heir
Thomas Oates and also for and in consideration of the sum of five
shillings to us in hand paid by the said Thomas Oates the receipt whereof
is hereby acknowledged.  Have given granted gifted settled estated and
confirmed and by these presents do and each of us doth give grant gift
settle estate and confirm unto and upon him the said Thomas Oates his heirs
executors administrators and assigns all and singular the said
estate lands and premises commonly called and known by the name of Ballafurt
consisting of one half quarterland bounded by the rent of Major Crebbin on
the south east, Rogane Moar on the southwest, Glantraugh on the  north and
north east and Greenock Harbour on the east and of the chief or Lord's rent
of sixteen shillings or thereabouts, together with a certain meadow called
by the name of Ballcurry's field or meadow
adjoining the estate of Balnahow in on the east and south and the estate
of Ballacurry on all other sides and also another field called by the name
of the Vicar's Croft or by some such other name or names the said estate
lands and premises may be called and known and of such chief rent as the
same now bears together with all houses edifices and buildings on the
said premises made and erected with the whole of the farming stock,
crop, implements, and utensils, goods chattels and effects household
stuff and furniture on the said lands and premises together with all
ways waters water courses easements liberties rights members and
appurtenances to the said estate lands and premises belonging or in any wise
appertaining. To Have and To Hold the said hereby gifted and settled
premises and every part parcel and member thereof with their and every of
their appurtenances unto the said Thomas Oates his heirs executors
administrators and assigns to the only use and behoof of the said Thomas
Oates his heirs executors administrators and assigns from the day of the
date hereof forever yielding and paying yearly and every year the chief rent
aforesaid with all dues duties suits and services incumbent thereon.
In consideration whereof I the said Thomas Oates doth hereby bind and oblige
myself my heirs executors administrators or assigns to keep support and
maintain the said John Oates and Margaret his wife my
father and mother with food and sufficient meat drink washing lodging
and clothing for and during their natural lives and the life of  the longer
liver or survivor of them.
And I the said John Oats and Margaret engage and agree that we have in
ourselves good right and full power to grant gift and settle the premises
in manner and form aforesaid and that we shall and will warrant
maintain and defend the said premises and every part parcel and member
thereof unto the said Thomas Oates his heirs executors administrators and
assigns
And for the sure making of this deed of Gift and  Settlement we have
with these presents delivered unto the said Thomas Oates a piece of
silver called an English shilling as livery and seizing of the said
premises.  And for the true and faithful performance of these presents I the
said John Oates and Margaret my wife and I the said Thomas Oates so far as
we are respectively concerned do hereby bind and oblige ourselves our heirs
and executors and admors and assigns in and under the penalty and forfeiture
of one thousand pounds lawful British money to be levied and paid according
to law.
In witness whereof we have hereunto subscribed our names the 6th day
of February in the year one thousand eight hundred and seventeen 1817. John
