38      Maughold
The humble petition of William Kerruish of Booilley Velt and William
Teare of Ballakinnag
Sheweth:  That about a year ago probate of the will of Ann Kerruish wife
of William Kerruish, Senior, was granted to your petrs and William Kerruish
Junior.
That the said William Kerruish Junior at the time of the death  of the said
Ann Kerruish was in possession of certain property which belonged to
the said Ann Kerruish and has since possessed himself of property which
belonged to  the said Ann Kerruish of considerable value of which he refuses
to give your  petitioners any account.
Wherefore your petrs pray a hearing of this petition and that your
Worship may be pleased to order that the said William Kerruish Junr do
forthwith return to the Archdeacons Registry a full true and particular
account of the goods and chattels rights and credits of the said Ann
Kerruish which have come to his hands or otherwise that your petr may obtain
such other relief in the premises as is just and your  petitioners
will pray.

Ordered that this petition do come on to be heard at a court to be holden at
Ramsey on Friday next whereof all proper parties to have due notice. Given

At an Eccl Court held in Ramsey the 10th May 1839
Upon hearing this pet in presence of the parties and their advocates and
upon consideration had thereof as well as of what was otherwise
pleaded offered argued and alleged by and on behalf of the parties
respectively I am of opinion that the defendant ought to furnish an account
in writing of all and singular the goods rights credits chattels
and effects of the deceased Ann Kerruish in this petition named  or contract
or which have come to his knowledge the said defendant is therefore hereby
ordered to return such account in writing to the Archdeacon¹s  Registry
within seven days after service hereof and in the mean time this petition is
continued

In the name of God Amen.
I Ann Kerruish alis Joughin wife of William Kerruish of Ballelin in the
parish of KK Maughold being advanced in years and decline of life do
make ordain and allow these presents to be my last will and settlement
hereby revoking and sitting aside all former will wills or testamentary
words by me made published or declared previous to the date hereof I
first commit my soul to God and my body to a decent Christian burial and as
touching and respecting my present worldly affairs I leave and devise and
dispose of in the following way and manner.
Item I leave devise and bequeath to William Kerruish son of my son
William Kerruish of Ballelin my share of sheep and all the notes I have
from my son William Kerruish and my share of all our horses.
Item I leave devise and bequeath to Ann Kerruish my grand daughter the one
half of the mortgage in Ballagorey thirty or thirty one pounds British with
arrears of interest.
I leave devise and bequeath to Robert Callow son of William Callow of
CardleVeg the sum of five pounds.
Item:  I leave devise and bequeath to the poor of the parish of KK
Maughold the sum of three pounds and five shillings legacy to every one that
crave a right to the effects of this will.
Lastly I nominate constitute and appoint my three loving children
William Kerruish Ballen, Catherine Kerruish Bolley vent and Ann Tear
Ballainag KK Andreas hole sole executors of all my goods and effects
moveable immoveable of what kind or nature so ever and also whatever notes I
hold belonging to any of my children the are not to be accountable for the
said notes and all the rest of my notes to be accountable between them
namely William Corkill, John Quayle, William Kissack.  In
testimony hereof I have cause my mark to be pleased to my name this the 30th
day of May 1837
