To the worshipful Thomas Arthur Corlett Vicar General etc. etc. etc
       The humble petition of Ann Kelly of the parish of Lonan Widow
Sheweth
        That Thomas Kelly of Barroose in the parish of Lonan lately departed this
life intestate leaving him Surviving ten children vizt Thomas Kelly John
Kelly Isabella Kelly Joseph Kelly Ann Callow wife of William Callow ­
Robert Kelly Charles Kelly Catharine Kelly Sophia Kelly and Margaret Kelly
entitled to his personal Estate.­ 
        That all the said Children except Thomas Ann & John Kelly are minors and
it being essentually (?) Necessary that some proper persons should be
appointed to Administer the said Estate and the said John Kelly being
absent from this Isle and in England your petitioner is desirous that her
son Thomas Kelly and John Killip of Lonan should be appointed and sworn
Administrators of the Estate of the said Thomas Kelly
        Wherefore your petitioner prays a hearing of this petition and that your
Worship may be pleased to appoint and swear the sd Thomas Kelly and John
Killip Administrator of the Estate of the said Thomas Kelly deceased and
your petr. will pray etc.

Ordered that this Petition do come on to be heard before me at an Eccl
Court to be held in Ramsey on Friday the 14th Inst whereof all proper
parties and persons to have due notice

Upon hearing this Petition in presence of parties it appears by Consent of
the parties that Thomas Kelly therein named departed this life some time
ago intestate leaving the Petitr his widow and Ten Children namely Thomas
Kelly, Anne Callow wife of Wm Callow, John Kelly, Isabella Kelly, Joseph
Kelly, Robt Kelly, Chs Kelly Cathn Kelly, Sophia Kelly; and Margt Jane
Kelly who are therefore Decreed next of kin of the deceased. [..?..]
[..?..] Thomas Kelly and John Killip by consent of all parties are hereby
sworn in trust well and truly to administer the personal Estate and effects
of the sd Deceadt to pay all his just debts and funeral expenses so far
forth as the Goods will extend and the law bind them and to return to the
Epl Registry a full true and perfect Inventory of the sd Goods and Effects
with an accurate account of all their acts and proceedings in the Premises
when thereunto lawfully required and to these ends they have given pledges
namely Thomas Christian and Wm Kneale who have entered into a Bond in due
form of law in presence of the Court

Whereas the Ecclesiastical Court of this Diocese hath this Day granted
administration of all and singular the Goods & Effects of Thos Kelly late
of Kk Lonnon deceased, to Thos Kelly & John Killip of Lonnon in trust for
Anne Kelly widow of decd and her Ten Children namely the sd Thos Kelly,
Anne Callow wife of Wm Callow, John Kelly, Isabella Kelly, Joseph Kelly,
Robt Kelly, Charles Kelly Cathn Kelly, Sophia Kelly, & Margt Jane Kelly.
And whereas Thos Christian of Begode in the Parish of Kk Lonnon and Wm
Kneale of the Rea in the Parish of Lonon have agreed to become pledges to
the said Thos Kelly & John Killip..., Therefore, Know all Men by these
Presents, that We, the said Thomas Christian and Wm Kneale hereby bind and
oblige ourselves, and our Executors, and Administrators, as Pledges to the
said Thos Kelly & John Killip for the due and faithful Administration of
the Goods and effects of the said Deceased, according to Law. Witness our
Subscriptions, this 14th Day of July 1843

Thomas Kelly of he Parish of Kirk Lonan having departed this life on or
about the twenty seventh day of December last Intestate, and this Court
having received intelligence thereof, hath (for the preservation of the
rights of all persons concerned) Decreed Ann Kelly administratrix of all
and singular the Goods, Rights, Credits, Chattels, and Effects, moveable
and immoveable whatever of the said Deceadent And she the said Ann Kelly is
thereupon sworn, well and truly to Administer the same, to pay all the
Intestate's just Debts so far forth as the Goods will extend and the Law
bind, and return unto the Episcopal Registry a full, true, and perfect
Inventory thereof, and an accurate Account of all Transactions touching the
same when thereunto lawfully required
And to these ends they hath given Pledges in form of Law, namely Thomas

The humble petition of Thomas Kelly and John Killip of the parish of Lonan
Administrators of the Estate of Thomas Kelly deceased
Sheweth
        That some time ago Thomas Kelly of Barroose in the parish of Lonan
departed this life intestate and your petitioners have been appointed and
sworn Administrators of his Estate.
        That the said Thomas Kelly at the time of his death was possessed of
extensive farming stock and certain goods and chattels to one moiety of
which Ann Kelly, the wife or widow of the said Thomas Kelly is entitled.
        That your petitioners are advised that it will be prejudicial to the
interest of the children of the said Thomas Kelly to have the goods and
chattels of the said Thomas Kelly divided and sold and that it would be
decidedly to the advantage of the said children to accept of the proposal
made by the said Widow who has offered to take the said childrens moiety of
the goods and chattels rights and credits which were of the said Thomas
Kelly at the valuation of a Jury of four competent persons and under the
circumstances your petitioners are induced to apply to your Worship and
your Reverence for your directions and authority to carry such proposal
into effect.
        Wherefore your petitioners pray a hearing of this petition and that your
Worship and your Reverence may be pleased to order that the Sumner of Lonan
do Summon and Swear a Jury of four good and intelligent men to inventory
and at full Value appraise the whole of the goods and Chattels rights and
credits which were of the sd Thomas Kelly at the time of his decease and
that your petitioners may be authorised to deliver up the same to the said
Ann Kelly upon receiving payment or Security for the payment of one moiety
of the Amount of such inventory and appraisement and your petrs will pray

Upon hearing this Petition and upon consideration of what was pleaded
offered and alleged in support thereof this Court is of opinion that is
would be to the advantage of all parties interested to have the Goods and
Chattels of the deceased Thomas Kelly valued by a Jury consisting of four
good and intelligent men and that the sumner of Kk Lonnon should forthwith
summon and convene to the Premises where the sd Goods now are the sd Jurors
and swear them to make a full and just valuation and appraisement of the s
Goods and chattels in order that the same may be returned to this Court by
the sd Jurors for its further directions and adjudication in the Premises
and the same is therefore hereby so ordered accordingly and in the mean
time this Petition is contd.

(Lengthy inventory follows)

Whereas Thomas Kelly of Barroose in the parish of Lonan sometime ago
departed this life intestate but during his lifetime contemplated making an
arrangement of his affairs and wherby certain provision would be made for
his younger children which arrangement he made known to his wife and
friends but being reduced in bodily health and otherwise afflicted such
arrangement was not carried into full effect in accordance with his
intentions and with strict form of law and whereas aby the decease of the
said Thomas Kelly intestate his children became entitled equally and share
alike to his moiety and his wife or widow Ann Kelly to the other moiety of
his personal estate ­ and the said Ann Kelly well knowing her deceased
husbands Will and intentions with regard to the disposition of the said
property and notwithstanding the death of her husband intestate being
determined so far as in her lies to carry his intentions into effect hath
therefore resolved to make over certain property in Trust for that purpose
­ Therefore Know all men by these presents that the said Ann Kelly Widow of
the said Thomas Kelly for the purposes aforesaid and in consideration of
the love and affection she hath and doth bear unto her children and of the
Sum of five Shillings to her in hand paid by John Killip of the sd parish
of Lonan and Thomas Kelly of Barroose in the sd parish the receipt whereof
is hereby acknowledged and the uses and trusts herein after mentioned

Hath Given Granted Transferred and assigned and by these presents doth Give
Grant Transfer assign and make over unto the said John Killip and Thomas
Kelly and the Survivor of them and the heirs and Assigns of such Survivor
all and Singular the sum of four hundred pounds payable by Thomas Kelly his
heirs Exors Admors and assigns unto the Survivor of them, the said Thomas
Kelly deceased and Ann Kelly under and by virtue of a certain deed made by
and between the said Thomas Kelly deceased Thomas Kelly and Ann Kelly and
bearing date the eleventh day of August one thousand eight hundred and
forty two. Also all and Singular the whole of her the said Ann Kellys right
title and interest in and to certain deeds of Bond and Security or Mortgage
chargeable upon the Estate of the Rhaa in the parish of Lonan together with
her right title and interest in and to the goods and Chattels rights and
credits whereof she and the said Thomas Kelly were possessed or of them and
the heirs and Assigns of such Survivor from henceforth forever ­ In Trust
nevertheless and upon the special confidence that they the said John Killip
and Thomas Kelly and the Survivor of them and the heirs and assigns of such
Survivor shall and will recover and receive the said Sum of four hundred
pounds and the amount of the said Bonds and Securities or mortages and
convert the said personal property into Cash and thereout invest at
interest on good landed Security or otherwise effectually secure a Sum
Sufficient to make up to the following children of the said Thomas Kelly
and Ann Kelly taking into account and computing in the first place their
respective shares of the personal estate of the said Thomas Kelly so much
of the said Trust money as will make up the following Sums of Money which
shall be payable to them as they respectively attain the age of twenty five
years namely unto Isabella Kelly two hundred pounds Catharine Kelly two
hundred pounds Sophia Kelly two hundred pounds Margaret Kelly two hundred
pounds Ann Callow twenty five pounds John Kelly fifty pounds Joseph Kelly
fifty pounds Robert Kelly fifty pounds and Charles Kelly the Sum of fifty
pounds. And pay over the Surplus of the said Money unto the said Ann Kelly
and in event of the death of any of the said Children before they attain
the said age of twenty five years the Share of him or her so dying shall
revert to the said Ann Kelly ­ and the said Ann Kelly doth covenant and
engage that she hath good right power and authority to assign and convey
the sd property in manner herein before mentioned and that she shall and
sill sign and execute any other deed or deeds necessary and proper to be by
her executed for the purpose of carrying into effect the objects and
intention of this deed and the uses and trusts herein before contained and
for the true and faithful performance hereof the said Ann Kelly John Killip
and Thomas Kelly reciprocally bind and oblige themselves their heirs exors
admors and assigns firmly by these presents   In Witness whereof they have
hereunto subscribed their names this 1st day of Decr one thousand eight
hundred and forty three

Thomas Kelly the executing parties thereby duly signed the same in presence

The foregoing deed of Settlement having been duly attested before a
magistrate the same is ordered to be recorded into the Episcopal Registry
for the benefit of all parties interested

Upon hearing this Petition in presence of the Parties and their advocates
and upon [radify ?] the appraisement this day returned to this Court by the
Jury sworn to make the same it appears reasonable and fair that the widow
of the deceased namely Anne Kelly be allowed to retain the Goods Chattels
and Effects [..?..] this Petition mentioned on paying the Petitrs one
moiety of the said appraisement amounting to the sum of four hundred and
forty three pounds fourteen shillings and nine pence brit ­and the same is
therefore hereby so ordered adjudged and decreed accordingly

and Isabella Caley otherwise Kelly his wife Do hereby [own?] and
acknowledge to have received and be paid the sum of Two hundred pounds from
Thomas Kelly of Barroose in the parish of Lonan and john Killip of
Ballacollister in the said parish of Lonan administrators in Trust of the
Estate of the late Thomas Kelly of Barroose aforesaid deceased and which
said sum of Two hundred pounds is the full amount of our share of any money
due to us or either of us from the Estate of the said Thomas Kelly. And we
do therefore desire that the payment of the said sum of Two hundred pounds
may be and stand cancelled upon [Record?]   As Witness our names this 30
day of June 1849

In the matter of a certain Deed of Settlement bearing date the Eleventh day
of August One thousand eight hundred and forty-two and made between Thomas
Kelly of Baroose in the Parish of Lonan and Ann his wife of the one part
and Thomas Kelly (the younger) of the other part.
I Thomas Lewin of Rose Villa Garwick in the Parish of Lonan being sworn
made oath and say as follows:
1. I  know and was well acquainted with the above named parties.
2. I  remember that Thomas Kelly the younger paid the sum of Four hundred
pounds referred to under the aforesaid Deed of Settlement on his entering
into possession of the Estates of Baldrine Barroose and part of Balladhoo
in the said Parish of Lonan.
3. I know from my own personal knowledge that this sum of four hundred
pounds along with other moneys referred to in an Agreement bearing date the
first day of December One thousand eight hundred and forty-three and made
between the said Anne Kelly then a widow of the one part and John Killip
and the said Thomas Kelly (the younger) of the other part (such Agreement
being filed along with the Grant of Administration to the Estate of the
said Thomas Kelly Senior made in the year One thousand eight hundred and
forty-three) was paid to and amongst the children of the said Thomas Kelly
and Anne Kelly in the proportions stated in the said Agreement with the
exception of those payable to their son Charles Kelly and their daughter
Sophia Kelly both of whom died under Twenty-one years of age and the
reasons for my knowledge are that I remember going to Ramsey many years ago
with the said Thomas Kelly Junior   I saw him pay to the said several
parties the sums to which they were entitled under the said Agreement.
