Mary Sayle als Radcliffe, 1844

This declared to be the last will and testament of one Mary Sayle wife of Thomas 
Sayle (Close) of the parish of Andreas being of sound mind and memory at the 
making and publishing hereof. And first I commit my soul to God and my body 
to decent Christian burial.

Secondly I leave and bequeath to my eldest son Thomas Sayle all my right Title and 
Interest to and in that parcel of Intack land situate in the parish of Andreas als 
commonly called “Close Elelests” the one half thereof to be possessed by him at and 
after my decease and the other half at and after the decease of his father Thomas 
Sayle, assessing thereat fifteen yards from East to West along side on the South of the 
high land adjoining the land of Jane Christian and back from the east to the lands of 
William W Christian  Esq. which parcel I hereby leave and bequeath to my daughter 
Catherine Sayle during her natural life time and after her death the said parcel to fall 
and ascend to my said son Thomas Sayle.
Thirdly I leave and bequeath to my two sons John and William Sayle ten pounds each 
and to my daughter Jane Sayle I leave the sum of Thirty pounds and to my daughter 
Catherine I leave Fifty pounds which said last mentioned legacies amounting to one 
hundred pounds in the whole are to be paid by my son Thomas Sayle aforesaid to my 
aforesaid children as they severally attain to the age of twenty one years the before 
mentioned lands being left and bequeathed by me to my son Thomas on the ________ 
condition that he binds himself to the payment of the same as they severally become 
entitled to receive the same and to all other  persons claiming I leave one shilling 
legacy.

Lastly I nominate constitute and appoint my beloved husband Thomas Sayle whole 
and sole executor of this my will to whom I leave all the rest residual and remainder 
of my goods chattels and effects of what nature or description so ever. In witness 
whereof I hereby subscribe my name as ad for my last will and testament this 12th 
day of January 1844.

Thomas Sayle Jr do hereby covenant ____ _____and bind myself my heirs exec 
administrators and assignees to the fulfillment of the will of my mother Mary Sayle as 
____ and declared in the before written paper writing purporting to be her last will 
and testament and that I will pay the said several legacies therein specified as the 
same becomes due Witness my subscription here to this 12th day of January 1844

The executor is sworn in form of law and hath given pledges for the payment of Debts 
and Legacies namely Philip Corlett and Robert Killip both of Ballachurry in the 
parish of Kirk Andreas.

I William Sayle a legatee named in the last will and testament of Mary Sayle late of 
the parish of Andreas deceased which will bears date the 12th day of January 1844. I 
hereby own and acknowledge that I have received from my brother Thomas Sayle the 
sum of ten pounds sterling the legacy bequeathed me in sum by said will and which 
sum said Thomas Sayle bound himself to pay as may more fully appear on referrance 
to said will. And I do hereby exonerate requit and discharge said Thomas Sayle his 
heirs exec administrators and assignees and every person whomsoever of  ___ from 
all further liability claim or demand on account of said legacy of ten pounds and 
every part thereof and do by those present fully cancel the same.
				As witness my subscription 
				This 15th day of February 1854

I John Radcliffe husband of Catherine Sayle a Legatee named in the last will and 
testament of Mary Sayle late of the parish of Andreas deceased. Which will bears date 
the 12th day of January 1844 do hereby own and acknowledge that I have received 
from my brother–in-law Thomas Radcliffe the sum of fifty pounds sterling the legacy 
bequeathed my said wife in and by said will and which sum said Thomas Radcliffe 
bound himself to pay as may more fully appear or referrance to said will and I do 
hereby exonerate acquit and discharge said Thomas Sayle his heirs execs 
administrators and assigns and every other person whomsoever of and form from all 
further liability claim or demand on account of said legacy of fifty pounds and every 
part thereof and do by these presents fully cancel the same.
					As witness my subscription this
