Malew Whereas the Ecclesiastical Court of this diocese hath this day granted probate of the last will and testament of John Christian, late of Malew, deceased to Patience Christian, the executrix herein named. And whereas Humphrey Mylchreest of Ballanodda in the parish of Malew and Robt. Christian of Douglas in the Parish of Braddan have agreed to become pledges to the said Patience Christian. Therefore, Know all men by all these presents, that we the said H. Mylchreest and Robt. Christian hereby bind and oblige ourselves, and our executors, and administrators, as pledges to the said Patience Christian for the due and faithful administration of goods and effects of the said deceased, according to law. Witness our subscriptions, this 29th day of Oct. 1844 Malew 1844 In the name of God, Amen - We John Christian and Patience Christian alias Quayle, wife of said John Christian by a second marriage, both residing in Croit-y-Cuddhair, part of the quarterland of the Estate of Clogh Chor in the Parish of Malew, at present the property of Robert Christian by the decease of his late mother and first wife of the above John Christian ... of said Croit-y-Cuddhair, and by the avoidance of his father's right to said property through his second marriage being of sound mind and memory do mutually and cordially unite in making and declaring this our joint Last Will and Testament, devise? considerations and advantages us hereunto moving? First - We commend our immortal souls to God through Our Lord Jesus Christ and our Bodies to decent Christian burial. Secondly - We jointly give and bequeath unto Robert Christian, our eldest son and heir and said Patience Christian's Step-Son all our Rights and Title to a certain parcel of land lately purchased by us commonly known by the name of Croit-y-Crommell, originally a part of the Estate of Clogh Chor in the Parish of Malew containing three acres of land or thereabouts more or less upon the following conditions and reservations, viz: That the said Robert Christian will leave us and the survivor of us in the full and peaceable ... and enjoyment of his said inheritance called Croit-y-Cuddhair, as hencetofore enjoyed by us since our second marriage rent-free during our natural lives or the life of the survivor of us or should the said Patience Christian become a widow, during her widowhood in the name of her present husband as above reserving to ourselves, or the survivor of us the benefits of said Croit-y-Crommell during our natural lives or the life of the survivor of us and widowhood as above. Otherwise, should we or the survivor of us be deprived of the annual benefits and advantages arising out of said Croit-y-Cuddhair to us rent-free, at any time during the abovementioned time or times, then and in such case, we revoke this intended Legacy of said Croit-y-Crommell to said Robert Christian, and we do hereby in such case, unite in bequeathing the whole of the said Croit-y-Crommell, at the decease of one of us, the survivor of us to be disposed of by him or her as he or she may think proper - but not so except in case of avoidance of us or the survivor of us as above in said Croit-y-Cuddhair. And moreover to manifest our love and affection for said Robert Christian we also leave and bequeath unto him at the decease of one of us and during the peaceable enjoyment of said Croit-y-Cuddhair by the survivor of us upon the above mentioned terms. The annual rent of a house and garden thereunto adjoining situate in the vicinity of Peel in the Parish of German lately purchased by us from Mrs. Corkhill, the said rent to cease to said Robert Christian at the decease of the survivor of us. Thirdly - We leave and bequeath unto our two sons Edward and Stephen Christian at the decease of the survivor of us the above mentioned house and garden thereunto belonging in the said Parish of German share and share alike. Fourthly - We leave and bequeath unto our two eldest daughters Catherine Cottier and Charlotte Faraker, the step-daughters of said Patience Christian the sum of five shillings each to be paid to them by the survivor of us. Fifthly - We leave and bequeath unto each of our two youngest daughter Margaret and Elizabeth Christian the sum of Fifteen pounds British Currency to be paid severally unto them by the survivor of us when they shall respectively have arrived at the age of twenty-four years and in case said Margaret and Elizabeth Christian or either of them shall depart this life before they shall have arrived at the age of twenty-four years, then the said legacy of Fifteen pounds each to revert to the survivor of us or the Executor or Executrix of said survivor. Lastly - We hereby jointly nominate and appoint the survivor of us sole Executor or Executrix of this our joint last will and testament giving and bequeathing to him or her, all and singular the whole of our personal Estate consisting of live and dead stock, crop, monies, notes and chattels moveable and immovable of every denomination whatsoever, and moreover all our land and houses wheresoever situated, subjecting the survivor of us as sole residuary legatee to the abovementioned conditions and reservations, also to the payment of the above legacies & our just debts and funeral expenses, bequeathing the legacy of one shilling to any relative who can legally move such legacy. And we do hereby jointly ratify and confirm this our joint last will and testament, mutually the one to the other, each and both of us revoking any and every other former Testamentary Writing or other Document or Instrument heretofore written and signed by us ... the arrangement of our property.
