Braddan
1846
108
The humble petition of Isaac Cannell of the parish of Braddan.
Sheweth as follows:
On the 4th day of January 1839 William Clucas of the Strang in the said
parish and Elizabeth his wife passed a Deed of Bond and Security or Mortgage
unto the said Daniel Fleming Wilson for the principal sum of
100 pounds with interest costs and charges secured on their undivided moiety
of the estate of Ballachrink in Baldwin in the said Parish.
Your petitioner became by purchase from the said Clucas proprietor of
the said encumbered lands and is now owner thereof.
The said Daniel Fleming Wilson died in the year 1846 of which they appointed
the survivor of them executor or executrix and on the death of the survivor
they appointed their son Senhouse Wilson executor.
The said Daniel Fleming Wilson predeceased his said wife and on the
11th day of December 1846 probate of the said will was granted to her the
said Ann Wilson.
The said Senhouse Wilson died in the year 1864 in the lifetime of the
said Ann Wilson who died in the year 1868.
The amount due under the said Deed of Bond and Security was many years ago
paid by the said Clucas but no receipt to cancel the same has ever been
recorded.
It is therefore necessary in order to cancel the said Deed of Bond and
Security that representation to the estate of the said Daniel Fleming Wilson
be set up.
Wherefore your petitioner humbly prays a hearing hereof and that letters of
administration of the estate and effects of the said Daniel Fleming Wilson
left unadministered by the said Ann Wilson and with the will of
the said Daniel Fleming Wilson annexed may be granted to some fit and proper
person and that your petitioner may have such other relief as is meet and he
will pray. James Gell Advocate for the petitioner.
