Esther Stowell Braddan 1850 To the Worshipful Vicar General Corlett The humble petition of Eliza Clarke of the town of Liverpool. Sheweth That Elizabeth[sic] [should read Esther] Stowell your Petitioners sister sometime since departed this life having first duly made and published her last Will and Testatment where she appointed your Petitioner Executrix and Residuary Legatee. That the said will was duly seen by your Petitioner at a Court holden in Douglas on the 15th day of February last when your Worship was pleased to ...... your Commission ...... to Thomas .... Moore of the Town of Liverpool Esquire ...... in your Petitioner to admin.(?) the said Will. That Petitioner on the 7th day of March instant was accordingly sworn in to execute the said Will by the said Thomas ...... Moore and the said commission with the proceedings thereunder have since been returned to your Worship. That Petitioner is prepared to give bail in the usual form and proposes as such bail William Fine Moore and Edward Moore both of the Town of Douglas. Wherefore Petitioner prays a hearing hereof and that your Worship may be pleased to accept the said bails and Petitioner will pray. Ridgeway Harrison for Petitioner At an Eccl. Court held in Ramsey the 22nd March 1850. Upon hearing this Petition and reading the Certificate returned to this Court by the Commissioners appointed by Commission bearing date the 28th of Feby. last past to administer the Oath appointed by Law to the Executrix Elizabeth Clark and upon consideration thereof I am of opinion that all has been duly executed and that probate should be extended in the usual form and be of the same force and effect as if the Executrix had personally appeared before me to be sworn to Execute the same and the same is therefore hereby so ordered adjudged and Decreed accordingly. T.A. Corlett At an Eccl. Court held in Ramsey the 22nd day of March 1850 Ridgeway Harrison one of the subscribing witnesses to the foregoing Will of Esther Stowell deceased (having at an Eccl. Court held at Douglas on the 15th day of February last past) made oath on the Holy Evangelists that the said Esther Stowell when of sound and disposing mind memory and understanding duly signed and executed the same in this Deponents presence and in presence of John Burke the other subscribing witness thereto, as and for her last Will and Testament – Administration of all and singular the Goods Rights Credits Chattels and Effects of said Testatrix are thereupon committed unto Elizabeth Clark the sole Executrix in said Will named (she having been first duly sworn by Thos. D. Moore Esq. of Liverpool by virtue of a Special Commission to him in this case directed) well and truly to fulfil and execute said Will according to Law, to pay all just Debts Legacies and Funeral expenses of the said Testatrix so far forth as the Estate will extend and the Law bind her, and to return to the Episcopal Registry of this Diocese a full true and perfect Inventory of said Goods Rights Credits Chattels and Effects with an accurate account of her acts and proceedings in the premises when thereunto lawfully required. And to these ends she hath given pledges namely William Fine Moore and Edward Moore who have executed a Bond to that effect bearing date the nineteenth inst. Probatum Est. T.A. Corlett The Worshipful Thomas Arthur Corlett, Esquire, Chancellor, Vicar General and Official Principal of the Right Honorable and Right Reverend Father in God Robert John by Divine Permission Lord Bishop of Sodor and Man. To Thomas Durie Moore of Liverpool in County of Lancaster, Esquire. Greeting Whereas Esther Stowell Relict of the late Thomas Stowell, Esquire, Clerk of the Rolls Isle of Man did on the fifth day of January 1849 make her last Will and Testatment, (which was duly proved approved and decreed valid by us, at an Ecclesiastical Court held in Douglas on the 15th instant) and therein nominate constitute and appoint her sister Elizabeth Clark sole Executrix and Residuary Legatee thereof. And whereas the said Elizabeth Clark resides in Liverpool aforesaid and by reason thereof cannot without great inconvenience and expense appear before us for the purposes hereinafter mentioned, and she having prayed that a Commission might be sped to you for the purposes hereinafter mentioned. We therefore in aid of Law (Justice so requiring) do hereby authorize and empower you the aforesaid Thomas Durie Moore to Administer the Oath below to the said Elizabeth Clark and further do in the premises as shall be needful requesting that (such Oath being administered) you duly transmit to us the whole proceedings thereon subscribed with your proper hand immediately after the Execution thereof together with these presents so that Justice may be administered in the premises. Given under our hand and Seal of Office at Ramsey in the Isle of Man this 28th day of February in the year of our Lord 1850. ----------Oath to the Executrix laying her right hand on the New Testament---------- I Elizabeth Clark Executrix of the Last Will and Testament of Esther Stowell late of the Parish of Braddan in the Isle of Man deceased, do swear that I will well and truly fulfil and execute the said Will, and administer the Goods, Rights, Credits, Chattels and Effects according to Law, by first paying the Testatrixes just Debts and then the Legacies therein contained as far as the same will thereto extend and the Law bind me, and that I will make or cause to be made a full true and perfect Inventory of all and singular the Goods, Rights Credits, Chattels and Effects of said Esther Stowell and and exhibit the same into the Episcopal Registry of the Diocese of Sodor and Man. And render a just account of my administration thereof when thereunto lawfully required. So help me God. I hereby certify that on the 7th day of March 1850 ) Elizabeth Clark I did duly administer the Oath at the foot of the above Commission ) to Elizabeth Clark the Executrix therein named, by virtue and ) in accordance of the said Commission. Thomas Durie Moore Commissioner WHEREAS the Ecclesiastical Court of this Diocese hath this day granted probate of the Will of Mrs. Esther Stowell late of the Parish of Braddan deceased, to Eliza Clark of the Town of Liverpool. AND WHEREAS William Fine Moore of Cronkbourne in the Parish of Braddan and Edward Moore of Barroule in the Parish of Conchan have agreed to become pledges to the said Eliza Clark for the due administration of the said Estate according to law. Therefore know all men by these Presents, that we, the said William Fine Moore and Edward Moore hereby bind and oblige ourselves and our Executors and Administrators, as pledges to the said Eliza Moore for the due and faithful administration of the goods and effects of the said deceased according to law. And in her default we bind ourselves and our Executors and Administrators to be answerable to all parties interested in the said Estate, or the Administration thereof.
