William Dinwoody Junior To His Worship Thomas Arthur Corlett Esquire Vicar General The humble petition of Thomas Dinwoody of the Green in the Parish of Malew Sheweth That your petitioners brother William Dinwoody Junior late of the parish of Malew departed this life on or about the month of May 1839 having first duly made and published his last Will and Testament in writing Probate thereof was on the 8th day of July 1839 granted to Richard Harrison, Esquire the Executor therein named. That the said Richard Harrison has since departed this life intestate. That the said Richard Harrison as Executor of the Will of the said William Dinwoody Junior was a party to certain proceedings in the Honorable court of Chancery to which your petr. is also a party and it is necessary that the Estate of the said William Dinwoody Junior should be represented in the said proceedings. That Margaret Dinwoody of the parish of German is the widow and William Thomas Dinwoody of the same parish the only next of kin of the said William Dinwoody Junior. Wherefore your petitioner humbly prays a hearing hereof and that Letters of Administration of the Estate and Effects of the said William Dinwoody Junior left unadministered by the said Richard Harrison deceased with the said Will annexed may be granted to some proper person and your petitioner will pray. Castletown 1 March 1860 Ordered that this petition do come on to be heard at an Ecclesiastical Court to be held at Castletown on Friday the 9th instant whereof all parties to have due notice. Given the 1 March 1860 At an Eccl. Court held in Castletown the 9th March 1860. Upon hearing this Petition in presence of the parties or their advocates and upon perusing an Official Copy of the last Will and Testament of William Dinwoody Junior decd. with the Probate granted therein in favor of Richard Harrison Esqr. the Executor therein named and it appearing that the sd. Richard Harrison some time ago departed this life Intestate without having fully administered the personal estate and Effects of the sd. William Dinwoody Junr. it is therefore become necessary that administration ______-_______ of the Estate and Effects of the sd. William Dinwoody Junr. should be granted to some fit and proper person and James Kewley being recommended he is therefore sworn well and truly to administer the unadministered part of the sd. Estate of the sd. William Dinwoody Junr. according to Law and also to return a true and faithful Inventory thereof with an accurate account of his acts and proceedings in the premises to the Episcopal Registry when thereunto lawfully required and to these ends he has given pledges namely Thomas Dinwoody and James Thomson who have entered into and executed the usual Bond in presence of the Court. Decretum Est. T.A. Corlett The late Mr. Wm. Dinwoody's Estate James Kewley's account as administrator with the Will annexed of the said William Dinwoody. There being no debts nor legacies and the only Estate of the said William Dinwoody being some articles of household furniture (he having disposed of all his money and real Estate in his lifetime) Thomas Dinwoody his son as Executor named in the said Will kept the whole of the said furniture in his possession no appraisement thereof was made. No claims were entered against the Estate and no demand was ever made on the said James Kewley by any person on account of the Estate. The said William Dinwoody had a claim of £107.3.2 with Int against the Estate of the late William Killey of Castltown and in respect of or for which the said James Kewley received from the Clerk of the Rolls from the Estate of the said William Killey on the 26th day of June 1876 the sum of £115.17.4 being £107.3.2 in full of the above claims (he having by authority of Dinwoody and his daughters Margaret and James Mychreest Merchant his Attorney) waived all claims for interest Killey's Estate being Insolvent and £8.14.2 costs due ___________ advocates obtaining consent of the Chancery Court to have that amount paid in preference out of Killey’s Estate. See Chancery Petition Book No. 36.B 1876 The said James Kewley paid out of the amount received by him from the Clerk of the Rolls as under viz _______ ________& _________Costs of Petition £ 9.14.2 Do due by Dinwoody to _________ & _________ 8.17.2 Sundry payments made by Jas. Kewley for Dinwoody's Estate 4. 8.10 To J. Mylchreest under power from Dinwoody 93.17.2 £115.17.4 The receipts for which several ________ annexed The foregoing Accounts is correct Aug 10th __________ Jas. Kewley WHEREAS the Ecclesiastical Court of this Diocese hath this day granted administration ________ of all and singular the Goods & effects of William Dinwoody Junior. AND WHEREAS James Thomson of Castletown in the Parish of Malew and Thomas Dinwoody of Green in the Parish of Malew have agreed to become pledges for the said James Kewley for the due administration of the said Estate according to Law. Therefore know all men by these Presents, that we, the said James Thomson and Thomas Dinwoody hereby bind and oblige ourselves and our Executors and Administrators, as pledges for the said James Kewley for the due and faithful Administration of the goods and effects of the said deceased according to law. And in his default we bind ourselves and our Executors and Administrators to be answerable to all parties interested in the said Estate, or the Administration thereof. Colvin, Mayor of the City of Chicago, County of Cook, State of Illinois, Uni- ted States of America, do here- by certify, that, on this day personally appeared before me, Thomas Dinwoody, the executing party to the deeds hereunto annexed, dated the 24th day of April, 1876 and acknowledged the same to be his proper acts and deeds. Given under my hand and official seal at the office of the Mayor of the City of Chicago County of Cook, State of Illinois, United States of America this the 24th day of April, 1876. H.O. Colvin Mayor City of Chicago I, Thomas Dinwoody late of Castletown in the Isle of Man but now residing in the United States of America do hereby nominate, constitute, and appoint James Mylechreest of Castletown aforesaid Merchant my attorney for me and in my name to receive and recover any sum or sums of money which may be due and owing to me in the Isle of Man whether the same be part of Moneys in the Court of Chancery of such Isle or otherwise. And for me and in my name to make execute and deliver Receipts and Discharges for any such sum when recovered. And to take all such steps and proceedings whether as Land or in Equity for the recovery of any such sum of Moneys. As Witness my subscription this 24th day of April 1876. Dinwoody I Thomas Dinwoody late of Castletown in the Isle of Man but now residing in the United States of America do hereby nominate constitute and appoint James Mylechreest of Castletown aforesaid Merchant my Attorney for me and in my name to receive and recover any sum or sums of money which may be due and owing unto me in the Isle of Man aforesaid whether the same has part of Moneys in the Court of Chancery of such Isle or otherwise. And for me and in my name to make execute and deliver Receipts and discharges for any such sum when received. And to take all such proceedings and steps whether at Land or in Equity for the recovery of any such sum of Money. And I hereby declare that the said moneys when received shall be held by the said James Mylechreest in Trust for me – Provided however that the receipt of my daughter Margaret Dinwoody shall be a good discharge to the said James Mylechreest for any sum of money paid by him to her on my account. And it shall be at the sole and absolute discretion of the said James Mylechreest what sum he shall from time to time pay to me or my said Daughter on my account out of the moneys which he may receive as aforesaid. I JamesMylechreest of Castletown the authorized Attorney of Thomas Dinwoody now residing in America but late of Castletown the son and residuary Legatee of the said Estate do authorize you to agree to accept from the Estate of William Killey deceased now being in course of distribution in the Court Chancery of the Isle of Man the sum of One hundred and seven pounds three shillings and two pence being the principal money of the claim of the said William Dinwoody deceased against the Estate of the said William Killey without Interest (liability of the _____________ distributed to the payment of interest being in dispute) ________ an order for this payment of the said sum to ________ at the next sitting of the Court Chancery on a Petition to be presented by you. And I hereby _______________ you harmless by ______ by you accepting this said sum without interest in case the said Thomas Dinwoody his Exer. Admin. or Assigns should question your authority to accept said sum without interest. And further I hereby undertake to ______ as ________ as conveniently may _______ from the said Thomas Dinwoody a discharge to you as Administrator of the said William Dinwoody's Estate in respect of your administration.
