Episcopal Will 1862 #28 KM

To His Worship Richard Jebb Vicar General
The humble petition of Robert Oates of Ballahonna in the parish of Michael.
Sheweth:
That in the month of August last past your petitioners mother Mrs Mary Oates departed
this life having first day of January 1861 duly made and executed a Deed of Settlement
or Gift whereby she conveyed to your petitioner for certain considerations in the said
deed set forth the whole of her remaining property real and personal and upon her death
there being still several out standing debts due in her name it became necessary that
administration of her esate should be granted to your petitioner in order to recover
such debts the said Mary Oates never having acquired one farthing of property after
the granting of such Deed your petitioner at a Chapter Court holden at Kirk Michael
on the 30th day of January last past applied for administration of the estate of
the said Mary Oates when Thomas C.Callow Esquire advocate as your petiitioner
understand without any authority entered an appearance for Thomas Killip of the
parish of Ballaugh and Elizabeth his wife who is a daughter of the said Mary Oates
to resist the granting of administration to your petitioner when your worship was
pleased that the said administration should lie over until next court. That your
petitioner submits that he is entitled to the administration of the estate of the
said Mary Oates she not having acquired any property whatever after the making of
the said Deed of the 1st day of January 1851 or at all events such other limited
administation as would reduce the outstanding estate in her name conveyed to him
by the said Deed of the 1st day of January 1861 into his possession.

Wherefore your petitiioner prays a hearing hereof and that adminisration of the
estate of the said Mary Oates may be granted to your petitioner in such form and
manner as to your worship may seem meet and that he be indemnified in his costs
and he will pray.
