The last will and testament of Thomas Gawne of Ballacorage in the
parish of Ballaugh being of sound mind memory and understanding do
make declare and publish this my last will and testament in manner
following:
First I commend my soul to God and my body  to Christian  burial.
I leave and bequeath to my son John Gawne the sum of five pounds as legacy.
I leave and bequeath to my grandson John Gawne the sum of five pounds
as legacy.
I leave and bequeath to my daughter Jane wife of Thomas Kneale five pounds
as legacy.
I leave and bequeath to my granddaughter Jane Kneale the sum of fifty pounds
as legacy.
I leave and bequeath my right under title to the estate of Ballacorage and
those parts and parcel of those intack lands which descended to me by my
father being a house and garden and small field called the Caillag situate
in the parish of Ballaugh, which was reserved by me, Court of the Settlement
given to my son  John to my beloved wife Isabella during her time and after
she decease the same to descend to my aforesaid son John she my said wife
having agreed and consented that her share of and right to our purchased
lands shall fall and descend to our said son John in case she happeneds to
survive me after her decease.
Lastly I nominate constitute and appoint my beloved wife aforesaid whole and
sole executrix of this my last will and testament and residuary
legatee of all the rest residue and remainder of my property goods bonds
chattels and effects moveable and immoveable wheresoever.  In witness
whereof I hereunto subscribe my name this the  6th day of July 1858.
The above mentioned legacies are not payable or to be recovered until after
the decease of my executrix this the 6th day of August 1858. Thomas Gawne

 11 Nov 1864 - Isabella Gawne sworn executrix with pledges  John
Gawne and Thomas Teare.

Whereas Thomas Gawne late of the parish of Ballaugh did by his last will and
testament proved by Isabella Gawne the executrix therein named at a Chapter
Court holden at Ramsey on the 11th day of Nov 1864 leave and bequeath to his
grandson John Gawne the sum of five pounds as a legacy and therein direct
that the legacies left by his will were not to be
payable until after the decease of his executrix and whereas Isabella Gawne
executrix as aforesaid died many years ago and immediately
proper to her death divided her estate including the personal estate left
to her by her husband and in which she had a life interest only among
certain persons and died without leaving any estate and whereas the said
legacy of 5 pounds to John Gawne grandson of the said Thomas Gawne,
has never been paid and Jane Julia Gawne granddaughter of the said Thomas
Gawne is now entitled to a portions of the lands left by her
father John Gawne for life and to his personal estate absolutely and whereas
representation has not been set apart to the estate of the said Thomas Gawne
since the death of the said Isabella Gawne and whereas
Jane Julia Gawne is the executrix of the will of her father John Gawne
proved on the 18th May 1903 at a court holden at Peel.  And whereas the said
Jane Julia Gawne has requested her brother John Gawne grandson of the
aforesaid Thomas Gawne for a release and discharge of the said
legacy of five pounds as far as any claim against her or her interest in
her late fatheršs estate is concerned which he hath consent to give. Know
all men therefore by these present that the said John Gawne in consideration
of the sum of five shillings to him in hand paid (the
receipt whereof I hereby acknowledge) doth hereby for himself his heirs
executor and administrators declare that he hath no claim against the
said Jane Julia Gawne as executrix of the will of her father John Gawne
or as beneficiary under such will and doth hereby for himself and his
aforesaid further release discharge the said Jane Julia Gawne executrix
as aforesaid and as beneficiary as aforesaid from all claims and
demands by him the said John Gawne his executors administrators and assigns
and doth also release and discharge for himself and his aforesaid the whole
of the interest and estate both real and personal taken by the said Jane
Julia Gawne under and by the will of her father John Gawne
from all claims and demands in respect to the said recited legacy of five
pounds bequeathed to him by the will  of his grandfather Thomas Gawne
as aforesaid.
In witness whereof the said John Gawne has hereto subscribed his name this
27th day of August 1904.
