The humble petition of Walter Daniel Clucas of Ramsey

Sheweth 

That William Clucas your petitioner’s father sometime since departed this life 
being first duly? And published his Last Will and Testament in? Whereof he appointed 
your petitioner executor. That your petitioner is desirous of taking upon himself the? 
And execution of said Will and obtaining probate thereof. Whereupon your petitioner 
prays a hearing of this petition and that your worship may be pleased to grant probate 
of this will of? William Clucas and appoint and swear your petitioner Executor thereunder 
in? of Laws and???  Robert James Kelly for Petitioner

Ordered that petitioner do come on to be heard at a Special Ecclesiastical Court 
to be holden at Ramsey this day whereof all proper parties to have due notice.

At an Eccl. Court holden at Ramsey on 15 April 1864 ? hearing? Petition in presence 
of parties or their advocates, probate of the Will of William Clucas was granted to 
the Petitioner as prayed for. Thomas C. Callow A.O.

Whereas, the Eccl. Court of the Isle and Dioceses of Sodor and Mann hath this day 
granted probate of the Will of William Clucas late of Ramsey to Walter Daniel Clucas 
the Executor named therein. And whereas Henry Thomas Lamothe in the parish of Maughold 
and Robert James Kelly of the said parish of Maughold have agreed to become pledges for 
the due and faithful Administration of the said Estate by the said Walter Daniel Clucas 
according to Law.

Now, Know all Men by these Presents, that we, the said Henry Thomas Lamothe and Robert 
James Kelly hereby bind and oblige ourselves jointly and severally, and our Heirs, 
Executors and Administrators firmly by these presents, as pledges for the said Walter 
Daniel Clucas that he shall well and truly administer, all and singular, the Personal 
Estate and Effects of the said deceased according to law. And in his default we bind 
ourselves, and each of us, for the whole. Our Heirs, Executors, and Administrators to 
be answerable and responsible to the said Court, and to all parties interested in the 
said estate and effects, or the administration thereof in the place and stead of the 
said Walter Daniel Clucas.

Witness our subscriptions this 15th day of April in the Year of our Lord One Thousand 
Eight Hundred and Sixty Four.	Henry T. Lamothe, Robert James Kelly.

At an Eccl. Court held in Ramsey on the 15th April 1864. The foregoing Bond and 
Obligation was signed, delivered and also acknowledged by the executing parties to 
be their proper Act and Deed.  Before me. Thomas C. Callow. ? Official.




The Will

This is the Last Will and Testament of me William Clucas of the Town of Ramsey, Surgeon.

I give and bequeath unto my daughter Louisa my Portrait, my Piano Forte, Gold Watch, 
and the Jewellery and trinkets which belonged to her Mother.

I give and bequeath to my niece Catharine Burton the sum of Ten Pounds.

I give devise and bequeath unto my said daughter Louisa an annuity or yearly sum of 
Thirty Five Pounds clear of all deductions which said annuity is to be and remain a 
lien and charge upon the Dwelling House offices and premises situate in Waterloo Road 
Ramsey aforesaid wherein I now reside - and I direct that my Executor hereinafter named 
shall pay the said annuity of Thirty Five Pounds unto such person or persons and to and 
for such intents and purposes and in such a manner as my said daughter shall from time 
to time notwithstanding any her future marriage to coverture, by any note in writing 
under her hand direct or appoint and in default of such appointment to pay the same 
into the hands of my said daughter for her own sole and separate use and benefit, so 
that the same may not be subject to the debts , engagements direction or interference 
of any husband she may marry and her receipt alone to be a sufficient discharge for the 
same - and in the event of my said daughter having issue by her marriage then my will 
is that the said annuity of Thirty Five Pounds per annum  may be devised by my said 
daughter to and amongst any child or children she may have lawfully begotten for his her 
and their life and the life of the survivor of them but no longer and in case of my said 
daughter having no child or children by her marriage then such annuity to cease and 
determine at the time of her death.

I give devise and bequeath to my son Walter Daniel Clucas All my Estates, Lands, Houses 
and premises of every nature and description whatsoever and wheresoever (subject nevertheless 
to the said annuity of Thirty Five Pounds) to hold to him his heirs and assigns for ever.

I do hereby give and bequeath the care and guardianship of my beloved daughter Louisa until 
she attains the age of Twenty one years unto my said son Walter Daniel Clucas and I do herby 
direct and request that such guardian shall and may attend to the education of my said child 
and employ proper persons to take care of her and her personal Estate education and fortune.

And I do hereby appoint my said son Walter Daniel Clucas whole and sole executor and residuary 
legatee of all the rest residue and remainder of my goods and chattels rights and credits of 
every nature and description whatsoever and whosoever - AS WITNESS my hand this second day 
of November one thousand eight hundred and sixty one.    William Clucas

Signed and delivered and acknowledged by the said William Clucas the Testator as and for his 
last Will and Testament in the presence of us present at the same time who at his request and 
in the presence of each other have hereinto subscribed our names as witnesses.

At an Ecclesiastical Court holden at Ramsey on 15th April 1864

Robert James Kelly and Thomas Corkill the subscribed witnesses for the foregoing paper writing 
purporting to be the last Will and Testament of William Clucas deceased having made oath on 
the Holy Evangelists that the said William Clucas when of sound mind and memory and understanding 
duly signed and sealed the same and for his last will and testament in their preserve. Walter 
Daniel Clucas the executor named in said will is therefore sworn well and truly to fulfil and 
execute the said will and to administer and singular the personal estate and effects of deceased 
according to law by paying his just debts and funeral expenses and the legacies in his will so 
far forth as the same will extend and the law bind him and to return unto the Archdeacons 
Registry a full true and perfect Inventory of all and singular? and estate and effects with 
an accurate account where thereunto lawfully requires of his admon thereof and to these ends 
he hath given pledges namely Robert James Kelly and Henry Thomas Lamothe who have entered into 
and executed the usual Bond in presence of the Court.
