The humble petition of Isabella Gawne of Laurel Bank in German spinster.
Sheweth
That petitioner's father Thomas Gawne of Laurel Bank in German
aforesaid died on the 17th day of June 1887 having first duly made and
published his last will and testament dated 26 Feb 1883 with codicil thereto
dated 26 April 1887 whereof he appointed petitioner sole
executrix
That petition is desirous of obtaining probate of the said will and
codicil.
Wherefore petitioner prays a hearing hereof and that your Honour may be
pleased to grant probate of the said will and codicil to petitioner
And petitioner will pray.  James Hodgson for petitioner
Ordered that this petition do come on to be heard at a Court to be held at
Peel on Monday the 27 day of June 1887 at 10 o'clock AM whereof all proper
parties are to have due notice.
Given this 23 June 1887        W. Gill
I Thomas Gawne of Laurel Bank in the parish of German in the Isle of Man and
formerly of the county of Grant in the Colony of Victoria make my
will as follows.
I leave my estate of Laurel Bank and Glenmoar Croft and all other my
real estate in German aforesaid to my wife Isabella for her lifetime and
after her death I leave the same to my daughter Isabella for her lifetime
and after her death to my son Thomas Gawne now of Ballarat for his lifetime
and after his death to his eldest son and his heirs and assigns
the said lands of Laurel Bank and Glenmoar Croft to be subject from and
after the death of my wife to the payment of ten pounds a year to be paid to
my daughter Margaret Hope Kneale during her life for her sole and separate
use free from all marital control and such payment to be made by my said
daughter Isabella and all others to whom the said lands shall devolve
according to the foregoing limitations during their respective estates
therein.
I leave to my four sons the said Thomas Gawne and William Gawne and
John Gawne of Victoria aforesaid and Edward Gawne of New Zealand and their
heirs and assigns in equal shares all my land near the Station at Geelong in
Grant County aforesaid and my land in the township of
Frankfort on the sea and all other real estate in Victoria aforesaid.
I leave to my three daughters Catherine Bridson, Eleanor Qualtrough and
Eliza Gawne twenty pounds each to be paid after the death of my wife
out of my personal estate.
I leave all other the residue of my personal estate to my wife Isabella
and her executors administrators and assigns if she survives me and in such
case I appoint her my executrix but if my said wife dies before me.
I leave the said residue to my said daughter Isabella and appoint her my
executrix.
In witness whereof I have hereunto subscribed my name this twenty
ninth day of Febuary one thousand eight hundred and eight three (1883)
I revoke all other wills made by me.

will and testament in presence of us who in his presence and in presence
of each other have hereto subscribed our names as witnesses.

Codicil
I hereby revoke and cancel that portion of my will which appoints that
ten pounds a year be paid to Margaret Hope Kneale out of lands of Laurel
Bank and Glenmoar Croft, also that portion which appoints twenty pounds to
be paid to each of my daughters Catherine Bridson, Eleanor Qualtrough and
Eliza Gawne, after the death of my wife out of my personal estate,
and in lieu thereof I sell and convey to the said Margaret Hope Kneal, the
said Catherine Bridson, the said Eleanor Qualtrough and the said Eliza Gawne
certain plots of land elsewhere described.
In witness whereof I have hereunto subscribed my name this twenty
sixth day of April one thousand eight hundred and eight seven (1887) Thomas
Gawne
Signed by the said Thomas Gawne the testator, in the presence of us, present
at the same time, who, in his presence, and in the presence of each other,
attest and subscribed our names as witnesses thereto. Thomas Cain

At a Court held at Peel on the 27th day of June 1887
The annexed paper writing dated the 26th day of February 1883 having been
proved to be respectively the last will and testament and a codicil thereto
of Thomas Gawne late of Laurel Bank in the parish of German formerly of the
county of Grant in the colony of Victoria Australia deceased who died on the
16th day of June 1887 and Isabella Gawne wife of the testator one of the
executrixes in the said will named having predeceased the testator Isabella
Gawne a daughter of the said testator the other executrix in said will names
is sworn well and truly to fulfill
and excute the said will and codicil and to administer the personal
estate of the said deceased according to law.     W.Gill
