Ballaugh 1904 247 This is the last will and testament of me Charlotte Corlett widow of Daniel Corlett late of the parish of Ballaugh deceased which I make publish and declare in form and manner following: Whereas by a certain Deed of Sale in Trust or Indenture bearing date the 25th day of March 1881 made between Thomas Callister then of the parish of Ballaugh of the first part and William Henry Corlett of the said parish of the other part (hereinafter called the trust deed) the said Thomas Callister for the considerations therein mentioned grant sell and convey the whole of his real estate wheresoever situate whether in the parish of Ballaugh, Andreas, or Lezayre or otherwise (hereinafter called the real estate) unto the said William Henry Corlett (hereinafter called the trustee) upon and for certain trusts in the trust deed set forth amongst others upon trust upon the decease of the said Thomas Callister by a good and sufficient deed in law to convey and make over the whole of the said real estate to such person or persons in such manner as I the said Charlotte Corlett should by my last will and testament or by any deed or deeds by me duly executed notwithstanding coverature direct and appoint. And whereas the said Thomas Callister dead and by a certain deed bearing date the 29 July 1893 made between the trustee of the first part me the said Charlotte Corlett of the second part and Edgar Richmond of the third part for the purpose of securing the repayment of a sum of three hundred pounds advanced to me by the said Edgar Richmond I partially appointed the said real estate (except a small meadow situate in the parish of Lezayre and a dwelling house and premises situate in the parish of Ballaugh) unto the said Edgar Richmond To Hold unto him subject to the provisoes in the said deed set forth and I thereby reserved to myself full power by deed or will to make pursuant to the trust deed any appointment there under in like manner as if the said deed of the twenty ninth day of July 1893 had not been made. And whereas by a certain deed of sale and appointment bearing date the 28th December 1896 I have further partially exercised the said power of appointment hereinbefore recited and did thereby appoint part of the said real estate and therein described to William Cowle of Ballaugh and by the same deed reserved to myself full power to further execute the said power of appointment. And whereas I am now desirous of further exercising the power of appointment in manner hereinafter mentioned. Now I hereby give and devise and in further exercise and execution of the power of appointment so vested in me by the Trust deed and of the power reserved to me by the said deed of the 29th July 1893 and of the deed of the 28th December 1896 and of all other power and authority whatsoever me in this behalf enabling the said Charlotte Corlett do hereby direct and appoint and do direct the trustee to convey All and singular the whole of the said real estate save and except those portions thereof heretofore appointed by me by the said deed of the 28th of Dec 1896 as hereinbefore recited and subject to said deed of the 29 July 1893 in manner following this is to say, unto and among my four children namely the said William Henry Corlett, Isabella Jane Corlett, John James Corlett and Thomas Arthur Corlett to hold to them and their several heirs and assigns as tenants in common and not as joint tenants absolutely. I also give and bequeath to the said Isabella Jane Corlett the sum of one hundred pounds and I nominate constitute and appoint the said Thomas Arthur Corlett of this my will hereby revoking all other wills and papers testamentary by me at any time heretofore made and executed and declaring this only to be my last will and testament.
