Ballaugh 1913 210 The humble petition of Joseph Benjamin Keig of the town of Ramsey Bank Agent and William Percy Cowley of the said town advocate. Sheweth: 1. That John Robert Craine late of Broughjairg Moar in the parish of Ballaugh farmer died on 9th day of July 1913 having first duly made and executed his last will and testament bearing date the 7th day of July 1913 whereof he appointed your petitioners executors. 2. That your petitioners are desirous that probate of the said will should be granted to them. Wherefore your petitioners humbly pray a hearing hereof and that your honor may be pleased to grant Probate of the said will of the said John Robert Craine to your petitioners and they will ever pray. F. M LaMothe for petitioners Ordered that this petition do come on to be heard at a court to be held at Michael on Monday the 21 day of July 1913 at 10:30 o'clock forenoon. Whereof all proper parties and persons are to have due and lawful notice. Given at Ramsey this 21 day of July 1913 Charles C. Callow Deemster Know all men by these presents that we Joseph Benjamin Keig of the town of Ramsey Bank Agent, William Percy Cowley of the said town Advocate, William Corkill of Riverside in the said town Accountant and Walter Craine of the said town Advocate Clerk are jointly and severally and any two of us jointly bound unto our Sovereign Lord the King in the sum of Ten hundred pounds 1,000 to the payment whereof well and truly to be made to our said Lord the King, his heirs and successors, we bind and oblige ourselves jointly and severally and any two of us jointly, our executors and administrators, firmly by these presents. As witness our subscriptions the Fifteenth day of July in the year of Our Lord One thousand nine hundred and thirteen. The condition of our obligation is such that if the above named Joseph Benjamin Keig and William Percy Cowley (hereinafter called "the executors") who seek to obtain a grant of Probate of the last will and testament of John Robert Craine late of Broughjairg in the parish of Ballaugh farmer but now decease, who died at Nobles Hospital Douglas on or about the 9th day of July 1913 do, when lawfully called on in that behalf make or cause to be made a true and perfect inventory of all and singular the personal estate and effects of the said deceased which have or shall come into their hands, possession, or knowledge or into the hands of any other person for them and the same so made do exhibits, or cause to be exhibited, into the proper Registry in that behalf whenever required by law so to do: And the same personal estate and effects of the said deceased which shall at any time come into the hands or possession of the executors, or into the hands of any other person or persons for them or which without default might have come into the hands or possession of the executors, do well and truly administer according to law, that is to say, do pay the debts and liabilities of the said deceased so far as the said personal estate will extend and the law bind the executors, then this obligation to be void and of no effect, or else to remain in full force and virtue. John R. Kennish This is the last will and testament of me John Robert Craine of Broughjairg in the parish of Ballaugh farmer. I revoke all former wills and I nominate constitute and appoint my friends Joseph Benjamin Keig of the town of Ramsey Bank Agent and William Percy Cowley of the said town Advocate (they and the survivor of them or other trustees or trustee for the time being of this my will being hereinafter called my trustees to be the executors and trustees of this my will. I give and bequeath to my dear wife Christian Margaret absolutely all my household furniture and effects and article of personal or domestic use or ornament. I give devise and bequeath all my real estate and all the rest residue and remainder of my personal estate unto my trustees Upon trust that they shall and will as soon as conveniently may be after my decease and in the case of my farm stock crop and implements not later than the twelfth day of November next following my decease sell call in collect and convert into money the said personal estate or such part thereof as shall not consist of money and after payment there out of my funeral and testamentary expenses and my debts shall apply the net balance then remaining firstly in executing such repairs (if any) as may be necessary to my real estate to put it into condition for letting upon lease as hereinafter provided and secondly in payment of the interest to the said Twelfth day of November and hereafter in reduction of the principal amount then remaining due on mortgage of my said real estate. And upon further trust that my trustees shall hold and stand possessed of my said real estate upon trust to let the same upon lease upon such terms and conditions as they may think fit and to pay the income rent arising there from yearly and every year to my said wife for and during the term of her natural life and as long as she remains my widow and unmarried. And upon her decease or remarriage (whichever event shall first happen) Upon trust to convey the said real estate absolutely to such one of my children or remoter issue as shall at the death or second marriage of my said wife be my heir or heiress at law but subject nevertheless to a lien or charge of seven hundred and fifty pounds which said sum of seven hundred and fifty pounds I give and bequeath to all my children then living (other than my heir or heiress at law as aforesaid) including any posthumous child or children and to the issue then living of any deceased child equally between them share and share like as tenants in common such issue to take if more than one equally between them the share of his her or their deceased parent. I declare that my trustees shall have power at any time to sell that portion of my real estate situate on the Southside of High Road between the village of Ballaugh and Cronkould - And shall hold the net proceeds of such sale upon such and the same trusts as are herein contained with respect to my residuary personal estate. I declare that my trustees shall be entitled to reasonable remuneration for their trouble and loss of time in executing the trusts of this my will.
